Terms of Service

1. Agreement to Terms

By accessing or using the La Bandera Kitchen website at labanderakitchen.com, placing an order, or submitting a catering inquiry, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.

2. Services

La Bandera Kitchen provides authentic Dominican catering, meal plan subscriptions, pop-up event food service, merchandise sales, and community meal sponsorship programs across the Bay Area, including Oakland, Berkeley, San Francisco, and surrounding cities.

All services are subject to availability. We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice. We operate under applicable California food handler permits and health department regulations.

3. Orders & Payments

  • All prices are listed in US dollars and are subject to change without notice
  • Payment is required to confirm catering bookings and meal plan subscriptions
  • We accept major credit cards and other payment methods as displayed at checkout
  • All transactions are processed through secure, PCI-compliant payment processors
  • Sales tax will be applied where required by California law
  • Minimum order requirements apply to delivery services
  • Prices displayed online are estimates; final pricing for catering events is confirmed in writing

4. Cancellation & Refund Policy

Please review our cancellation policy carefully before booking. Deposits are non-refundable in most circumstances.

Catering Events

  • Cancellations made 14+ days before the event: Full deposit refund minus a 10% processing fee
  • Cancellations made 7–13 days before the event: 50% of deposit refunded
  • Cancellations made less than 7 days before the event: Deposit is non-refundable
  • Cancellations within 48 hours of a scheduled event: Full contracted amount may be charged
  • Rescheduling requests made 7+ days in advance will be accommodated subject to availability at no charge

Meal Plan Subscriptions

  • Subscriptions may be paused or cancelled at any time with 48 hours notice before the next delivery
  • Refunds for delivered meals are not available unless there is a quality issue
  • Quality issues must be reported within 24 hours of delivery with photographic evidence

Merchandise

Merchandise may be returned within 30 days of purchase if unused and in original condition. Food items are non-returnable for health and safety reasons. To initiate a return, contact [email protected].

5. Food Safety & Allergen Disclosure

Our kitchen handles and prepares food containing the following major allergens: wheat/gluten, dairy/milk, eggs, tree nuts, peanuts, soy, shellfish, and fish. Cross-contact is possible. We cannot guarantee any menu item is free from allergens. If you have a severe food allergy, please contact us before ordering.

La Bandera Kitchen operates in compliance with California Retail Food Code (CalCode) and holds applicable Alameda County Environmental Health permits. Our food handlers are certified under California Food Handler Card requirements.

  • It is your responsibility to inform us of any food allergies or dietary restrictions before placing an order
  • We will make reasonable accommodations but cannot guarantee allergen-free preparation
  • Customers with life-threatening allergies should consult with us directly before ordering
  • Menu items and ingredients may change; always confirm current ingredients when ordering
  • Consuming raw or undercooked foods may increase the risk of foodborne illness

6. Community Meal Sponsorship

Important Notice: La Bandera Kitchen is not currently a 501(c)(3) nonprofit organization. Sponsorships support our community meal efforts and are not tax-deductible charitable donations unless otherwise stated in writing.

Community meal sponsorships are voluntary contributions that help La Bandera Kitchen provide warm Dominican meals to seniors, veterans, families, unhoused neighbors, and people in need across the Bay Area. These are community partnerships, not charitable donations. We will provide a written acknowledgment of your contribution upon request.

7. Intellectual Property

All content on this website, including the La Bandera Kitchen name, logo, photographs, recipes, and written content, is the property of La Bandera Kitchen and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use our content without written permission.

8. Limitation of Liability

La Bandera Kitchen shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services. Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under California law.

9. California Consumer Rights

As a California consumer, you have rights under the California Consumer Legal Remedies Act (CLRA), the Unfair Competition Law (UCL), and other applicable statutes. Nothing in these Terms waives any rights you have under California law.

If a dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing litigation. Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes not resolved through mediation shall be resolved in the courts of Alameda County, California. You consent to personal jurisdiction in Alameda County.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.
